This Complaint Procedure is established to meet the requirements of Title VI of the Civil Rights Act of 1964. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of race, color, or national origin in the provision of services, activities, programs, or benefits by the City of Colorado Springs (“City”). The City’s Personnel Policies and Procedures Manual governs employment-related complaints of protected class discrimination.

The complaint should be filed in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the alleged discrimination. A complaint form can be obtained below.  Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for the persons with disabilities upon request.

The complaint should be submitted by the complainant and/or his/her designee as soon as possible but no later than 180 days after the alleged incident to the Accessibility Manager/ Title VI Coordinator as follows:

Within 10 business days after receipt of the complaint, the Title VI Coordinator and/or his/her designee will acknowledge receipt of the complaint and within 15 calendar days forward the complaint to the appropriate federal agency, unless a shorter notification time is required, and meet with the complainant to discuss the complaint and any possible resolutions. Within 60 calendar days of the meeting, the Title VI Coordinator and/or his/her designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as a language other than English, large print, Braille, or audio tape. The response will explain the City’s position and offer options for substantive resolution of the complaint.

If the response by the Title VI Coordinator and/or his/her designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 14 business days after receipt of the response to the City’s Chief of Staff or his/her designee.

Within 30 calendar days after receipt of the appeal, the Chief of Staff or his/her designee will meet with the complainant to discuss the complaint and possible resolutions. Within 30 business days after the meeting, the Chief of Staff or his/her designee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

All written complaints received by the Title VI Coordinator or his/her designee, appeals to the City’s Chief of Staff or his/her designee, and responses from these two offices will be retained by City for at least three (3) years and submitted to the appropriate federal agency at the conclusion of the complaint.
